Helping You Make Informed Bankruptcy Decisions

Bankruptcy in the United States is governed by federal law, but with some important differences from state to state. Proceedings take place in bankruptcy courts under several different chapters of the U.S. Bankruptcy Code. The following are the chapters that are most relevant to my clients:

  • Chapter 7 discharge of debts: This chapter allows qualified filers the ability to completely eliminate (discharge) certain debts in a relatively short time period.
  • Chapter 13 reorganization plans: This chapter allows those who qualify the ability to repay many debts over the course of three to five years, and some debts can be reduced.

Which chapter you file under can make a big difference, and your decision should be made on the basis of skilled legal advice. Contact me to discuss your circumstances with an experienced Washington bankruptcy lawyer.

Getting Powerful Benefits for Bankruptcy Filers

There are several immediate and long-term benefits that you may — depending on your specific circumstances — be able to achieve by filing for bankruptcy, among which are the following:

  • Stop foreclosure: Filing for bankruptcy can enjoin any impending foreclosure sale and may allow you to save your home in the long run.
  • Stop wage garnishment: Your bankruptcy filing can also put a stop to wage garnishment orders by creditors who have gotten judgments against you.
  • Stop harassing phone calls: Creditors and debt collection agencies may not call you to try to collect on your debts once you have filed for bankruptcy.
  • Home and car loan modification: Filing for bankruptcy may give you leverage in achieving modification of a home or car loan.
  • Life after bankruptcy: Once you emerge from bankruptcy, you can take immediate steps to rebuild your credit and get a fresh start.

Every case is different, and you should consult an experienced attorney about exactly how you may be able to benefit from filing for bankruptcy.
